Terms of Use

Effective date: 18 October 2026. These terms explain the rules for using SKILLSPACE. By creating an account or using member-only features, you agree to these terms. If you do not agree, do not use the platform.

1. What SKILLSPACE provides

SKILLSPACE is intended to bring together online work opportunities, learning materials, service listings, member tools and membership options. A listing is an invitation to review a possible task or service, not a guarantee that work will be awarded, that income will be earned, or that a client will accept a submission. Availability, eligibility and features may change.

2. Accounts and accurate information

You must provide accurate information, keep your account details up to date, and protect your login credentials. You are responsible for activity performed through your account. Tell SKILLSPACE promptly if you suspect unauthorized access. Do not impersonate another person, create accounts to evade limits, or misrepresent your skills, identity or payment status.

3. Memberships and access

Membership access is determined by the plan associated with your account. Public visitors may see categories, while account holders can access member features according to their plan. Free, Basic, Standard and Premium have different task allowances and access levels. Premium is required for Academy learning materials. A user may see a listing that their current plan does not allow them to open or submit; an upgrade may be required. Plan prices are shown in USD and may also show an approximate KSh equivalent. The KSh figure is indicative and can change with exchange rates or payment-provider charges.

4. Tasks, submissions and review

Read the instructions, scope, deadline, budget and required deliverables before starting a task. Submit original work that follows the task brief and respects copyright, confidentiality, privacy and applicable law. Submissions are pending review until an authorized administrator approves or rejects them. A submitted item is not approved merely because it was uploaded or recorded. Review outcomes should be based on the task requirements; where appropriate, feedback may be provided. Do not submit harmful files, plagiarized work, fabricated results, or personal information collected without permission.

5. Services and client requests

Service descriptions identify typical deliverables and indicative starting prices. Confirm the final scope, delivery time, revisions and price before committing to a service. Do not use the platform to request or provide illegal, deceptive, abusive, discriminatory or infringing services. SKILLSPACE may remove listings or restrict accounts to protect members and platform integrity.

6. Payments, refunds and withdrawals

Paid membership is not active until the payment is verified by the authorized payment system and the account is updated accordingly. Entering a phone number or viewing a payment-pending message is not proof of payment. M-Pesa processing, where enabled, will be subject to Safaricom and payment-provider terms. Never share your M-Pesa PIN or one-time passcodes with SKILLSPACE or another user. Fees, refunds, disputes, withdrawal minimums and timelines must be disclosed before a live transaction is enabled. The current browser-only prototype does not itself initiate or verify real M-Pesa transactions. Referral programme: a member may earn a commission equal to 25% of the membership amount actually paid by a client attributed to their referral code, after the payment has been verified. No commission is earned for a free plan, an unverified or failed payment, a self-referral, or a payment that is refunded or reversed. The browser-only prototype records demonstration commissions locally and does not itself transfer or pay out money.

7. Acceptable use and intellectual property

Do not attempt to bypass plan limits, interfere with site security, scrape private data, distribute malware, manipulate reviews or submissions, harass other users, or misuse referrals. You retain rights to materials you create, subject to any separate agreement with a client. You must have permission to upload or share any third-party content. You grant SKILLSPACE only the limited permission needed to host and display content for operating the service, where that functionality is enabled.

8. Suspension and termination

SKILLSPACE may restrict or suspend access when reasonably necessary to investigate fraud, abuse, security issues, unlawful activity or serious violations of these terms. Where practicable, the platform will communicate the reason and provide a way to raise a concern. You may stop using the service and request account or personal-data action through the support channel, subject to lawful retention obligations.

9. Availability and disclaimers

The platform is provided subject to availability. We will take reasonable steps to maintain accurate listings and protect the service, but cannot promise uninterrupted access, specific earnings, task availability, client outcomes or error-free operation. Browser-only demonstrations may not synchronize across devices and should not be used to store sensitive information.

10. Liability and disputes

To the extent permitted by applicable law, SKILLSPACE is not responsible for indirect losses arising from use of listings or third-party services. Nothing in these terms excludes a right or liability that cannot legally be excluded. Please contact support first so concerns can be reviewed. These terms are intended to operate consistently with the laws of Kenya, including applicable consumer-protection and data-protection requirements.

11. Changes and contact

These terms may be updated as the service changes. The latest version will be published on this page with an updated effective date. Use the Support section for questions. These terms are a general platform template and should be reviewed by qualified Kenyan legal counsel before the site launches for live transactions.

Privacy Policy

Effective date: 18 October 2026. This notice explains how SKILLSPACE may handle personal information. It is written with reference to the principles and data-subject rights described in Kenya's Data Protection Act, 2019. It is not a claim of formal legal compliance or a substitute for a final review of the live system.

1. Information that may be collected

Depending on the features enabled, information may include your name, email address, country, skill interests, membership plan, task activity, submitted file names and notes, service requests, support messages, payment request metadata, and basic account or transaction status. A live payment integration may also receive a phone number and payment reference from the payment provider. Do not submit your M-Pesa PIN, passwords for other services, identity documents or unrelated sensitive information through free-text fields.

2. Why information is used

Information may be used to create and manage accounts, show plan-appropriate features, administer task allowances, receive and review submissions, respond to service and support requests, manage membership payments, prevent fraud or abuse, maintain platform security, resolve disputes, and improve the service. Information should not be reused for unrelated purposes without an appropriate lawful basis or notice.

3. Legal basis, fairness and minimization

When SKILLSPACE operates as a live service, the operator should identify and document an appropriate lawful basis for each processing purpose, explain any required consent, collect only data reasonably necessary for that purpose, keep records accurate, and apply suitable retention periods. If consent is relied on, it should be informed and capable of being withdrawn where applicable.

4. Where information is stored

This version of SKILLSPACE is a browser-based prototype. Some demo account, task, service-request, submission, support and payment-request records are saved in the browser's local storage. They may not be sent to a server, synchronized across devices, or visible to an administrator using another browser. Anyone who can access the same browser profile or device may be able to inspect local records. Do not use real passwords or upload confidential or sensitive information in this demo. A production deployment must replace browser-only storage for accounts, permissions, submissions and payments with a secure backend.

5. Sharing and service providers

For a live service, information may be shared only as reasonably necessary with authorized platform administrators, service providers hosting the platform, security or technical providers, and payment providers such as Safaricom when an M-Pesa transaction is actually enabled. Information may also be disclosed where required by law or to protect legal rights and safety. The operator should document relevant processors, use appropriate contracts and safeguards, and avoid selling personal data.

6. Cross-border processing

Hosting or service providers may process data outside Kenya. Before doing so in a live service, the operator should assess applicable Kenyan transfer requirements and put adequate safeguards or another lawful mechanism in place. The operator should disclose material cross-border processing where required.

7. Retention and security

Personal information should be retained only for as long as reasonably necessary for the purpose, legal obligations, payment reconciliation, dispute resolution or legitimate security needs. Appropriate safeguards for a production system include access controls, least-privilege administration, encrypted transport, secure password hashing, protected secrets, backups, audit trails and a process for handling suspected data breaches. Browser local storage in this prototype does not provide those protections.

8. Your rights

Subject to applicable law and any relevant exceptions, you may request to be informed about use of your personal data, access data held about you, object to certain processing, request correction of inaccurate or misleading information, and request deletion where appropriate. You may also raise concerns with the Office of the Data Protection Commissioner in Kenya. Use the Support section to submit a request. The operator should verify identity proportionately before responding and should not expose another person's information.

9. Cookies, local storage and analytics

This prototype uses browser local storage and session storage to remember demo account state, selected plans, task use, and other local interactions. It does not mean those records are securely stored on a server. If analytics, advertising cookies or other tracking technologies are added later, the notice and any consent controls should be updated before use.

10. Children

SKILLSPACE is not intended for children to provide personal information without appropriate authorization and safeguards. The live operator should define and enforce a minimum-age policy and obtain parental or guardian authorization where legally required.

11. Third-party sites and payment services

Links to third-party services are governed by their own privacy notices and terms. SKILLSPACE cannot control their practices. For M-Pesa, users should review Safaricom's relevant notices and never disclose their PIN or one-time passcodes to anyone.

12. Updates and contact

This policy may change as features, providers or legal requirements change. The latest version will appear here with a revised effective date. For access, correction, deletion, objection or other privacy requests, use the Support section. Before processing real members' information, the site operator should add the actual legal entity/contact details, retention schedule, live processors, complaint channel and any required registrations or assessments.
